AGC-NYS.jpgAGC Files Suit – Questions Legality of MWBE 30% Goal 

In an effort to gain insight to and request justification for the 30% MWBE goals set on NYS construction projects, the Associated General Contractors of New York State (AGC NYS) has spent several months requesting related documentation through the Freedom of Information Law (FOIL). However, after many months of subsequent delays and/or denials, the AGC felt they had no choice but to file official Article 78 proceedings to demand these documents be released. Although our industry and the AGC have a long history of supporting appropriate MWBE goals to increase opportunity and diversity, we also know the reality, which shows there are not enough MWBE firms qualified to do such work. This makes it nearly impossible to meet the 30% mandate, which appears to be an arbitrary number chosen at will by the Governor, and not a number based on any industry facts or analytical data.
